After winning on all issues on appeal, The Block Firm has negotiated a successful resolution of the landlord/tenant dispute that threatened the existence of its small-business client, Main Street Burger.
This case began after Main Street Burger’s landlords refused to honor the rent and renewal provisions in the parties’ lease ten years early, threatening to put the company out of business and putting a popular local restaurant in Kennesaw, Georgia at risk. After years of litigation, the Georgia Court of Appeals held that Main Street Burger’s lease was enforceable in every respect, and the parties have now resolved all remaining issues and put the case to bed.
Under the settlement agreement, Main Street Burger recovered a substantial portion of its attorneys’ fees in a lump sum payment as well as an adjustment to its lease rights to provide more favorable payment terms over the remaining life of the tenancy. At the same time, the resolution fully preserves the rights and protections that Main Street Burger has under its lease, as found by the appellate court.
