Allison Brennan Bailey recently secured educational supportive measures for a college student survivor of sexual assault after the college initially refused to provide accommodations in violation of the student’s federal civil rights.
Our client reported that she had been drugged and violently assaulted by another student on campus. She was struggling to complete her final projects and exams in the aftermath of the reported attack. The school informed the student she would be required to either withdraw or take an “incomplete” in her classes, thereby blemishing her transcript and setting her back a semester.
Allison stepped in at this point to negotiate on behalf of the student, and informed the college of its legal obligation under Title IX of the Education Amendments of 1972 to provide supportive measures to restore our client’s equal access to her education. The school subsequently allowed our client to take a leave to recover, retake her failed exams, make up all missed course work, and stay on track to earn her degree in the expected time. We are so proud of Allison!
